Article 1. Purpose

The general terms and conditions of sale described below detail the rights and obligations of the company entretoise-express and its customers in the context of the sale of parts available on the sales site entretoise-express.fr.

Any service provided by the company entretoise-express implies the buyer's unconditional acceptance of these general terms of sale.

Article 2. Prices

The prices of the goods sold are those in force on the day the order is taken. They are denominated in euros.

Additional and variable shipping costs are applied to each order placed.

The company entretoise-express reserves the right to modify its prices at any time.

However, it undertakes to invoice the goods ordered at the prices indicated at the time the order is registered.

Article 3. Discounts and rebates

The proposed prices include the discounts and rebates that the company entretoise-express may grant in view of its results or the assumption of responsibility by the buyer for certain services.

Article 4. Discount

No discount will be granted in case of advance payment.

Article 5. Terms of payment

Payment for orders is made by credit card, bank transfer and via the Paypal online payment platform.

At the time of registration of the order, the buyer must pay the total amount of the invoice.

Article 6. Default of payment and retention of title clause

In case of total or partial non-payment, the order cannot be shipped.

The company entretoise-express retains ownership of the goods sold until full payment of the order price.

Article 7. Delivery

The delivery is carried out by sending from our warehouses located in France to the address given by the buyer or in a relay point, for the attention of the buyer.

The delivery time indicated when the order is placed is given as an indication only and is not guaranteed. However, the company entretoise-express undertakes, in accordance with article L.121-20-3 of the French Consumer Code, to deliver the order within 7 working days for metropolitan France from the date of receipt of payment.

Consequently, any reasonable delay in the delivery of the products shall not give rise to the benefit of the buyer to :

- the allocation of damages and interest;

- the cancellation of the order

The transport risk is borne entirely by the buyer.

Article 8. Condition of the goods

In the event of missing or damaged goods during transport, the buyer must formulate all necessary reservations on the order form upon receipt of the said goods. These reservations must also be confirmed in writing within 5 days of delivery, by registered letter.

Article 9. The withdrawal period

The spacers are personalised and custom-made products. Consequently, it is not possible to return them after receiving them.

Article 10. Validity of electronic exchanges

The Customer acknowledges the validity and the evidential value of electronic exchanges and records made by entretoise-express.fr and accepts that said records have the same evidential value as a handwritten document signed by hand.

Article 11. Limits of use

The items offered on the entretoise-express.fr website, when installed on mopeds, do not make them approved for road use. By placing an order on the entretoise-express.fr site, the buyer therefore undertakes not to infringe the legislation on the modification of motorised vehicles by misusing the parts ordered. Although designed with a constant concern for reliability, entretoise-express cannot guarantee the perfect resistance of its products when they are subjected to situations other than those for which they were designed, i.e.: adding an aesthetic dimension to vehicles reserved for display.

Article 12.  Force majeure

The company entretoise-express cannot be held responsible if the non-execution or the delay in the execution of one of its obligations described in the present general conditions of sale results from a case of force majeure. In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.

Article 13. Jurisdiction

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. In the absence of an amicable settlement, the dispute shall be brought before the Strasbourg Commercial Court.
